Foreclosure notice of default in TX– what is it?

By Carl Lane, Owner — Optimum Home Buyers

Texas is a non-judicial foreclosure state, which means the process moves faster here than almost anywhere in the country — a notice of default in Collin County can lead to a courthouse-steps sale in McKinney in a matter of weeks, always on the first Tuesday of the month. Here’s what that letter actually is, what it starts, and how to use the time it gives you.

What the Notice of Default Is

It’s the lender’s formal declaration that your loan is in breach, sent by certified mail, and under Texas Property Code §51.002 it must give you at least 20 days to cure — pay the stated arrears and fees to bring the loan current. For homestead loans, Texas layers in an earlier breach notice with at least 30 days before the loan can be accelerated. The letter is unpleasant; it is also your official clock, and the dates in it outrank anything anyone tells you on the phone.

What Happens If the Cure Window Passes

  1. Acceleration: the lender declares the entire balance due — not just the missed payments.
  2. Notice of sale: filed with the Collin County Clerk, posted at the courthouse, and mailed to you at least 21 days before the auction date.
  3. The first-Tuesday sale: the trustee auctions the property between 10 a.m. and 4 p.m. After a Texas mortgage foreclosure sale there is no right of redemption — it’s final.

Your Four Moves, Ranked by Stage

  • Cure it — if you can raise the reinstatement amount, this erases the default. Get the exact figure in writing; it grows with fees.
  • Work it out — modification, repayment plan, or forbearance can still land during this window, especially with a complete application. Free help: HUD-approved counselors.
  • Refinance — possible with equity and income, but lates make it harder every month; start immediately or not at all.
  • Sell before the sale — converts your equity to cash and records a normal sale instead of a foreclosure. A direct cash sale closes in 7–14 days; even a listing can work if the auction is 60+ days out.

A Warning About Your Mailbox

The notice of default and notice of sale are public records — and public records get scraped. Expect letters, calls, and door-knocks from investors, ‘rescue’ services, and outright scammers within days. Some local buyers are legitimate; verify every one of them with this checklist — proof of funds, title-company closing, math on paper. Anyone charging an upfront fee to ‘save your home’ is not saving your home.
